Appeals court reject attempt by Joe Reed to remain on ASU trustee board

By Atlanta-based court upholds Joe Reed's removal from trustee board

Montgomery, AL – - A federal appeals court has turned back
veteran black political leader Joe Reed's attempt to regain his
seat on the Alabama State University board of trustees.
A three-judge panel of the Atlanta-based 11th U.S. Circuit Court
of Appeals on Thursday upheld a federal district court that said
Reed was properly removed from the board when he turned 70 in
September 2008.
Reed had argued that an exception in the law shielded him from
being removed at 70.
But the appeals court found that legislative action altering the
terms of ASU trustees provided an orderly reshuffling of the board
and was not intended to give trustees such as Reed life tenures.
