Ala judge tells state to issue tax refunds

By Ala franchise tax ruled illegal, refunds ordered

Montgomery, AL – - A Montgomery County circuit judge has
ordered Alabama to pay the first of what may be many refunds in the
more than a decade-old lawsuit over Alabama's franchise tax.
The Alabama Supreme Court upheld a lower court ruling in 1999
that the franchise tax was unconstitutional because in-state and
out-of-state businesses were charged different rates.
Circuit Judge Charles Price on Monday ordered the state to pay a
refund of $30,211 plus interest to one of the companies, Vulcan
Lands, Inc.
New York Times newspapers in Gadsden and Tuscaloosa first
reported on the refund order.
Vulcan is one of about 110 corporate taxpayers that may be owed
as much as $150 million in refunds.
